Welcome to Baby Steps ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website and services located at ivf.clinic (the "Service") operated by Baby Steps, a Delaware corporation.

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Baby Steps provides estimated success rate intervals and IVF clinic analysis services. Our Service includes:

  • Estimated success rate intervals based on the age, diagnosis, stimulation type, and donor status you provide
  • IVF clinic comparison and analysis tools
  • Clinic outcomes reported to the U.S. Centers for Disease Control and Prevention (CDC)

The Service is free to use. We do not sell anything.

3. Data Source and Medical Disclaimer

Estimated success rate intervals are derived from clinic outcomes reported to SART (the Society for Assisted Reproductive Technology) and the CDC. The CDC clinic figures and charts come from the CDC's public data.

IMPORTANT: The information provided by our predictive model is for informational purposes only and is not intended to substitute for professional medical advice, diagnosis, or treatment. The model provides statistical estimates based on historical data and should not be the sole basis for medical decisions. Individual results may vary significantly based on numerous factors not captured in our model. Always consult with a qualified healthcare provider regarding your specific circumstances before making medical decisions.

Our Service is not a medical device and does not provide medical advice, diagnosis, or treatment. We are not licensed healthcare providers.

4. User Accounts

4.1 Account Creation

The Service can be browsed without an account. You may create one, using your email address and name, to save clinics to a favorites list and to keep your settings across devices.

4.2 Account Responsibility

You are responsible for safeguarding your account credentials and for all activities under your account. You must immediately notify us of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to terminate or suspend your account at any time for violation of these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BABY STEPS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You expressly consent and submit to the exclusive jurisdiction of the courts of the State of Delaware for any legal action or proceeding arising out of or relating to these Terms or your use of the Service.

Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in the State of Delaware. The decision of the arbitrator shall be final and binding upon the parties and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on our website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
